Media PI insurance covers claims relating to libel, slander or defamation; unintentional infringement of intellectual property rights; breaches of a licence to use copyrighted material; commitment to media space or print time; reputation management.

Let’s look at each of these areas in detail.

Claims relating to ‘Libel, Slander or Defamation
This relates to the defamation or other tort related to disparagement of character, harm to reputation or feelings of any person or organisation including libel, slander or defamation, product disparagement and malicious falsehood, trade libel or any claim relating to outrage or emotional distress.

Unintentional infringement of intellectual property rights
This includes copyright, slogan, trademark, domain name or metatag, moral rights, misappropriation of, formats, characters, trade names, character names, titles, plots, musical compositions, voices, slogans, graphic material or artwork, passing off and plagiarism and commercial appropriation of name or likeness.

Breaches of a licence to use copyrighted material
Qdos provides a follow up to this which provides cover for then the insured breaches a licence to use copyrighted material. This means:

The unintentional breach of a license to use a third party’s trademarked or copyrighted material but only to the extent that use exceeds the express limitations in the license regarding territory, duration or media in which the material may be used and only when made as a part of a claim under the above.

Commitment to media space or print time
This means if a photographer, for example, hires a studio space for a contract but the client says they shouldn’t have hired the studio - and so won’t pay for the hire costs - the photographer can claim for it on their PI policy.

Reputation Management
There is a ‘reputation management’ section – capped at £250k– whereby if you have a negligence claim made against you then you can claim on this section for a PR or crisis management consultant to protect your businesses reputation.
